Fisheries
Agreement dated the 6 day of January 2012
Between
Beecher Bay First Nation, also known as Scia’new Nation (hereinafter called “Organization”)
Of the first part
And
Her Majesty The Queen in Right of Canada as represented by the Minister of Fisheries and Oceans (hereinafter called “DFO”)
Of the second part
Whereas existing Aboriginal and treaty rights at recognized and affirmed in section 35(1) of the Constitution Act, 1982;
And whereas in entering into this Agreement, the parties are not seeking to determine the existence, nature, scope of Aboriginal or treaty rights, but rather are seeking to provide for the orderly management of the fisheries and the involvement of the Organization in the conservation, management, protection and enhancement of aquatic and fisheries resources and supporting habitats;
And whereas the Parties are both interested in the conservation, protection and management of aquatic resources;
And whereas the Parties confirm their commitment to a relationship based on mutual respect and understanding;
And whereas DFO agrees to contribute funding to the Organization to support the Organization in carrying out the Activities in accordance with the terms and conditions of this Agreement;
And whereas DFO is providing funding to the Organization to support the involvement of the Organization in the orderly management, protection and enhancement of aquatic and fisheries resources and supporting habitats;
Now therefore the Parties agree as follows:
- Purpose
The purpose of this Agreement is to:
- provide for the involvement of the Organization in the management, protection and enhancement of aquatic and fisheries resources; and
- set out the arrangements by which DFO will contribute funding to the Organization to support the Organization in carrying out the Activities.
- Interpretation
the Parties agree that this Agreement:
- acknowledges the understanding of the Parties that existing aboriginal and treaty rights, including Douglas Treaty rights, are recognized and affirmed in section 35
